A High Court in Benue State, on Monday, issued a restraining order prohibiting Dr. Iyorchia Ayu from portraying himself as the People’s Democratic Party’s National Chairperson (PDP).
Due to suspected anti-party conduct, Ayu was expelled from the party on Sunday in his Benue ward.

But, he asserted on Monday that he is still the PDP’s national chairman and that, in accordance with the constitution, the ward lacks the authority to remove him from that position.
A member of the PDP from Benue, Terhide Utaan, who is the plaintiff before Justice W. I Kpochi, obtained the order restraining Ayu from parading himself as national chairman of the party.
The plaintiff had sought an order of interim injunction restraining Ayu from parading himself as the National Chairman of the PDP, having lost his membership of the party, pending the hearing ad determination of the motion on notice already filed.
According to Justice Kpochi;
Upon hearing Mr. M.T. Assoh of Learned Counsel ably moved the application and upon a dispassionate consideration of the facts placed before me in the pool of the affidavit evidence, and again, upon the consideration of the issues distilled in the written address by M.T. Assoh, it is my candid view that this is a proper case to grant the interim injunction as craved.
Consequently, this application is hereby granted in terms of the reliefs captured in the motion papers as herein before reproduced. It is so ordered.
The judge adjourned the case to 17 April, 2023 for hearing.
