In a significant development at the Benue Governorship Election Petition Tribunal (BGEPT), it has been unveiled that Governor Hyacinth Alia may face disqualification due to his American citizenship.

During the opening of the All Progressives Congress’ (APC) defence, evidence emerged suggesting that the current Governor of Benue State holds American citizenship.

This revelation was supported by the submission of INEC Form EC 9, which was filed by the Governor during his gubernatorial campaign.

The question arises as to whether the Nigerian Constitution allows a citizen of another country to hold the position of Governor within the country.

Section 182 (1)(a) of the Nigerian Constitution explicitly states that it is not permissible. It reads as follows: “No person shall be qualified for election to the office of Governor of a state if – (a) Subject to the provisions of Section 28 of this Constitution, he has voluntarily acquired the citizenship of another country other than Nigeria or, except in such cases as may be prescribed by the National Assembly, he has made a declaration of allegiance to such other country.”

The revelation raises a significant constitutional issue that may impact the tenure of Governor Alia. The court will now deliberate on the matter and make a determination.

As the case progresses, the court’s decision will be eagerly awaited by the parties involved.
