The Federal Competition and Consumer Protection Commission (FCCPC) has initiated an investigation into the business practices of Coca-Cola Nigeria Limited and Nigerian Bottling Company. The commission is probing allegations of misleading trade descriptions and unfair marketing tactics related to the companies’ “Original Taste” and “Less Sugar” Coca-Cola variants.
According to the FCCPC, the companies may have violated Section 116 of the FCCPC Act and Section 124 1(a) of the Commission’s Establishment Act. The commission alleges that Coca-Cola Nigeria and NBC misled consumers by suggesting that the “Original Taste, Less Sugar” variant is identical to the “Original Taste” variant in terms of formulation.
The FCCPC has also indicated that it will take further regulatory action regarding potential abuse of dominance by the companies, with penalties to be determined in due course.
