Another Legal Setback for Trump as Judge Blocks Birthright Citizenship Ban
A second federal judge has blocked US President Donald Trump’s executive order that seeks to end birthright citizenship.
The ruling marked another blowback against Trump’s efforts to end birthright citizenship, a policy he introduced on his first day in office.
The prior ruling paused implementation for 14 days after 18 states’ attorneys general filed lawsuits challenging it.
On Wednesday, Deborah Boardman, a US district judge, made a decision that will last through appeal.
Passing judgment during a hearing, Boardman said the order “conflicts with the plain language of the 14th Amendment, contradicts 125-year-old binding supreme court precedent, and runs counter to our nation’s 250-year history of citizenship by birth”.
“No court in the country has ever endorsed the president’s interpretation,” she added. “This court will not be the first.”
Boardman, appointed by former President Joe Biden, said the injunction needed to apply nationwide.
“The government will not be harmed by a preliminary injunction that prevents it from enforcing an executive order likely to be found unconstitutional,” she said.
